1. General Agreement
By accessing or using the marina and its services, the customer acknowledges and agrees to be bound by these Terms and Conditions as well as all posted marina rules and safety guidelines. KDM Marina retains the right to update or modify these terms without prior notice. Continued use of the marina constitutes acceptance of any revised terms.
2. Eligibility
All renters must present a valid government-issued ID. Slip renters must be at least 18 years old. Yacht renters and anyone operating a rented vessel must be at least 21 years old and must comply with all United States Coast Guard and Florida boating requirements.
3. Reservations and Payments
A valid credit or debit card is required to secure all reservations. Deposits may be required for both yacht rentals and long-term slip reservations. All balances must be paid in full before departure or occupancy. Pricing may vary based on season, vessel size, and availability. KDM Marina reserves the right to cancel a reservation if payment requirements are not met.
4. Cancellation and Rescheduling
For yacht rentals, cancellations made at least seventy-two hours before the scheduled rental time may qualify for a full refund. Cancellations within seventy-two hours may result in the forfeiture of deposits or the application of a cancellation fee. No-show reservations are charged in full.
For slip rentals, customers on monthly agreements must provide at least thirty days’ written notice prior to cancellation or departure. Failure to provide proper notice may result in the loss of deposits or the billing of an additional month’s slip fee. KDM Marina may cancel bookings due to unsafe weather, maintenance needs, or safety concerns; affected renters may receive a refund or be permitted to reschedule without penalty.
5. Check-In and Check-Out
Specific check-in and check-out times for yacht rentals will be provided during booking. Slip renters must vacate their assigned slip by the agreed departure date unless an extension has been approved by marina management. Late departures may result in additional charges.
6. Weather Policy
Miami Beach weather can change quickly, and KDM Marina prioritizes guest and staff safety. The marina may delay, reschedule, or cancel a rental in the event of small craft advisories, severe storms, high winds, or any conditions deemed unsafe by marina staff. Renters who cancel due to personal preference on otherwise safe-weather days are subject to the normal cancellation policy.
7. Vessel Condition and Damages
All vessels and slip areas must be returned in the same condition as received. Renters accept full responsibility for any damage caused by negligence, misuse, or failure to follow instructions. This includes damage to marina property, docks, equipment, or other vessels. Renters are also responsible for lost equipment, towing needs, or cleaning charges if the vessel is returned excessively dirty. Damage assessments made by KDM Marina are final.
8. Safety Requirements
All guests must comply with United States Coast Guard regulations, Florida boating laws, and all marina signage. Life jackets must be used when required. No vessel may be operated under the influence of drugs or alcohol. If a rental includes a captain or crew, their instructions must be followed at all times. Unsafe behavior may result in immediate termination of the rental without refund.
9. Insurance and Liability
Renters understand that boating involves inherent risks. KDM Marina is not liable for personal injury, accidents, loss of personal property, theft, weather-related damage, or any damages arising from negligence or improper vessel operation. Slip renters must maintain valid boat insurance and may be required to list KDM Marina as an additional insured. Yacht renters may be required to provide a security deposit or purchase supplemental damage coverage. To the fullest extent permitted by law, KDM Marina is not responsible for indirect, incidental, or consequential damages.
10. Guest Conduct
All guests must conduct themselves respectfully and responsibly while on marina property. Excessive noise, disorderly behavior, harassment, illegal activity, or unsafe boating practices are strictly prohibited. Damage to docks, utilities, or marina facilities is not permitted. Guests who violate conduct rules may be removed from the property without refund.
11. Dock Access, Utilities, and Maintenance
Slip rentals may include various utilities depending on the specific agreement. Renters must keep docks clear, clean, and unobstructed at all times. Electrical and water connections may not be altered or tampered with. Vessels must be properly secured to avoid drifting or causing damage. Any concerns regarding dock safety or functionality should be reported immediately to marina staff.
12. Fuel, Waste, and Environmental Compliance
All waste must be disposed of properly in designated locations. Renters may not dispose of fuel, oil, sewage, chemicals, or hazardous materials into the water. Pump-out stations must be used for sewage. Fuel spills or environmental hazards must be reported immediately. Violations may result in fines, termination of rental, or removal from the marina.
13. Personal Belongings
KDM Marina is not responsible for the theft, loss, or damage of personal items left on vessels, docks, or inside vehicles. Guests are encouraged to secure their belongings at all times.
14. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from marina use or rental agreements will be handled exclusively within Miami-Dade County, Florida.
